EU - Approval of Sulfur Dioxide as an Active Substance for Use in Biocidal Products

On December 2, 2013, the European Chemicals Agency (ECHA) received an application for approval of sulfur dioxide released from sodium metabisulfite as an active substance for use in biocidal products of product-type 9 - Fibre, rubber and polymerized materials preservatives.

On January 22, 2018, the German evaluating competent authority submitted the assessment report on the application, concluding biocidal products of product-type 9 using sulfur dioxide released from sodium metabisulfite is expected to satisfy the criteria laid down in the Biocidal Product Regulation (BPR). Therefore, it is approved the use with certain conditions.

Date of Approval: August 1, 2023

Expiry date of approval: July 31, 2033

New RoHS Exemption for Mercury Learn more.

EU - New RoHS Exemption for Mercury

​On April 26, 2021, the EU Commission received an application for the exemption of mercury in melt pressure transducers for capillary rheometers at temperatures over 300 °C and pressures over 1000 bar in Annex IV to RoHS Directive. The evaluation concluded that substitution of mercury in melt pressure transducers for capillary rheometers at temperatures over 300 °C and pressures over 1 000 bar are currently scientifically and technically impracticable. Therefore, it is appropriate to grant the exemption in Annex IV to the Directive with respect to electrical and electronic equipment of category 9 (Monitoring and Control Equipment) and the following entry is newly added to the corresponding Annex:

'49 Mercury in melt pressure transducers for capillary rheometers at temperatures over 300 °C and pressures over 1000 bar - Applies to category 9 and expires on December 31, 2025.

The new exemptions shall be applied from February 1, 2024.

On July 11, 2023, Commission Regulation (EU) 2023/1442 was published, which is to amend Annex I to Regulation (EU) No. 10/2011 on plastic materials and articles intended to come into contact with food, as regards changes to substance authorizations and addition of new substances.

Summary of changes:

1. Point 1, Table 1 is amended as follows:

- entry 96 on wood flour and fibers, untreated, and entry 121 on salicylic acid are deleted;

- entry 157 on phthalic acid, dibutyl ester is replaced 

- entry 159 on phthalic acid, benzyl butyl ester is replaced

- entry 283 on phthalic acid, bis(2-ethylhexyl) ester is replaced 

- entry 728 on phthalic acid, diesters with primary, saturated C8-C10 branched alcohols, more than 60 % C9 is replaced

- entry 793 on triethanolamine is replaced

- entry 822 on perchloric acid, salts (perchlorate) is replaced 

- entry 1007 on diethyl[[3,5-bis(1,1-dimethylethyl)-4-hydroxyphenyl]methyl]phosphonate is replaced

- entry 1059 on poly((R)-3-hydroxybutyrate-co-(R)-3-hydroxyhexanoate) is replaced 

- entry 1076 on Phosphorous acid, triphenyl ester, polymer with alpha-hydro-omega-hydroxypoly[oxy(methyl-1,2-ethanediyl)], C10-16 alkyl ester is replaced 

- the following entries are inserted at the end of Table 1 in numerical order: 1078,1080 to 1083

2. In point 2, Table 2 is amended as follows

- entry 7 is replaced 

- entry 26 is replaced

- entry 32 is replaced 

- the following entries are added: 36 to 38

3. In point 3, Table 3, the entry (30) is added.

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

EU - Restriction of Formaldehyde and Formaldehyde Releasers Adopted

​The European Commission adopted the restriction of formaldehyde and formaldehyde releasers on July 17, by adding a new entry to the Annex XVII to Regulation (EC) No 1907/2006 (REACH Regulation). It also specifies the test conditions by adding a new Appendix (Appendix 14) to the Regulation.

The new restriction entry sets limits for wood-based products and interior in vehicles, with certain exemptions, effective on August 6, 2026 and August 6, 2027 respectively:

1. ​≤​ 0.062 mg/m3 for indoor use furniture and wood-based articles

2. ≤​ 0.080 mg/m3 for articles other than furniture and non-wood-based articles​

​3. ≤​ 0.062 mg/m3 for interior of vehicles​

Formaldehyde is a highly reactive gas at ambient temperature and atmospheric pressure conditions and classified as carcinogen category 1B, mutagen category 2, acute toxicants category 3, skin corrosive category 1B and skin sensitizer category 1 under Regulation (EC) No 1272/2008 (CLP Regulation).

EU - Commission Decision (EU) 2023/1338 Safety Requirements to be Met by European Standards for Certain Children's Products Pursuant to GPSD 2001/95/EC

​Recently the ​Commission Decision (EU) 2023/1338 was published on June 30, 2023, stipulating the safety requirements to be met by European standards for certain children’s products and related products pursuant to Directive 2001/95/EC of the European Parliament and of the Council.

This Decision applies to the European standards referred to in Article 4(1) of General Product Safety Directive (GPSD) 2001/95/EC for the following products:

(a) children’s products intended to be worn by children;

(b) children’s products intended to facilitate or protect the seating function, sleeping function, bathing function, body care, relaxation, transportation and early learning;

(c) children’s products intended to facilitate the feeding, drinking or sucking of children;

(d) children’s products that offer one or several functions listed in points (a), (b) and (c) and one or several other functions;

(e) products related to children’s products, including the following products:

(i) products and accessories specifically designed for use with children’s products referred to in points (a) to (d) or in combination with those products;

(ii) products to be used and mounted or installed by adults which are accessible to a child or offer a protective function to a child.

​The European Commission released a Commission Delegated Directive to amend Annex IV to Directive 2011/65/EU (RoHS Directive) by adding entry 41a to the Annex:

41a. Lead as a thermal stabilizer in polyvinyl chloride (PVC) used as base material in amperometric, potentiometric and conductometric electrochemical sensors which are used in in vitro diagnostic medical devices for the analysis of creatinine and blood urea nitrogen in whole blood.

Applies to category 8 and expires on December 31, 2023.

EU - The New Battery Regulation Published

​​The European Commission published the new battery and battery waste Regulation on 28 July. The new Regulation remains most of the chemical and labelling requirements set forth in the Directive 2006/66/EC. However, it also adds a restriction limit for lead and a labelling limit for Cadmium. The main chemical and labelling requirements are as follows:

​Amendments to the Industrial Chemicals (General) Rules 2019 (General Rules) affects the export or importation of decabromodiphenyl ether (decaBDE), perfluorooctanoic acid (PFOA), its salts and PFOA-related compounds.
Manufacturers/suppliers of decaBDE, PFOA-related compounds need to apply to AICIS for import/export authorization, from July 21, 2023.

China - Banning Five Persistent Organic Pollutants

​The Ministry of Ecology and Environment (MEE) of the Mainland China, together with other 10 ministries, published an announcement on 6 June 2023 banning the following five persistent organic pollutants (POPs), effective immediately. 

1. Hexachlorobutadiene (HCBD)
2. Polychlorinated naphthalene​ (PCN)
3. Pentachlorophenol and its salts and esters (PCP)
4. Decabromodiphenyl ether (decaBDE)
5. Short-chain chlorinated paraffins (SCCP)

Basically, five POPs are prohibited from production, use, import and export in China with certain exemptions for decaBDE and SCCP.

Exemptions for decaBDE:
- Textile products that need to be flame-retardants, excluding clothing and toys, i.e. decaBDE shall not be used in clothing and toys.
- Additives in plastic enclosure and components used in household heating appliances, iron, fans and immersion heater with density less than 10% by weight of the component.
- Polyurethane (PU) foam used for building insulation

Exemptions for SCCP:
- Additives used in the production of conveyors belts in the natural and synthetic rubber industry
- Spare parts for rubber conveyor belts used in mining and forestry
- The leather industry, particularly in fatliquoring of leather
- Lubricating oil additives
- Outdoor decorative lamps
- Water- and oil-resistant paints
- Adhesives
- Metal processing​
- Plasticizer in polyvinly chloride (PVC) (but shall not be used in any toys and children's products)

All exemptions will be expired on December 31, 2023.

​The Chinese State Administration for Market Regulation published new announcement on mobile power sources. Products including Li-ion batteries, mobile power banks, battery adapters/chargers, will be regulated under CCC Approval regulations, the application for CCC approval can be started since August 1, 2023.  

From August 1, 2024, above-mentioned mobile power sources products without CCC approval and mark, will be prohibited to be supplied on the market.

​South Korea Ministry of Land, Infrastructure and Transport (MOLIT) announces revision of the Rules on the Performance and Standards for Motor Vehicles and their Parts.

The existing the Rules on the Performance and Standards for Motor Vehicles and their Parts will be abolished.

A. Give exemption from applying the maximum slope angle of vehicle rollover to the special purpose vehicles that has special structures or equipment for certain tasks, such as testing bridges, moving furniture, and distinguishing fire (Article 8).

B. Specify that the detailed regulations of TPMS and LDWS shall be announced by the

Minister of MOLIT (Article 88-3, 89-2, Annex 6, Annex 6-29).

C. Allow emergency light to be lighted on consecutively as well as the current simultaneous flickering of turn signals (Annex 6-19).

D. Allow to equally apply the larger value between ± 100kg and ± 3% to mid-sized vehicles and large sized vehicles for the specification tolerance for vehicle weight (Annex 33).

Taiwan - Proposed to Prohibit PFHxS and its Salts

​The Taiwan Environmental Protection Administration (EPA) proposed to list perfluorohexane sulfonic acid (PFHxS) and its salts and related compounds as toxic chemical substances in the Schedule 1 of the Toxic and Concerned Chemical Substances Control Act (TCCSCA) as the substances were added into the Stockholm Convention last year. The EPA proposed to completely ban the uses of the group of substances except for research, experimental and educational purposes.

The limits of perfluorooctane sulfonic acid (PFOS), perfluorooctane sulfonate lithium salt, perfluorooctane sulfonyl fluoride and perfluorooctanoic acid (PFOA) are also going to be revised from 0.01% to completely prohibited.

The industry will be given at least 6 months up to 18 months to adapt to the changes after the enforcement. The comment period will end on August 10, 2023.

​Taiwan Metrology and Inspection (BSMI) announces Draft of Amendments to Requirements on Minimum Energy Performance Standard and Energy Efficiency Rating Labelling and Inspection for Dehumidifier with a view to enhancing the efficiency of energy use, the Bureau of Energy intends to modify the minimum energy performance standards and energy efficiency rating labelling requirements.

The testing and calculation of energy factor for Dehumidifiers shall comply with the following requirements:

- The tested value of energy factor (EF) shall be tested in accordance with CNS 12492.

- The measured value of EF rounded off to the second decimal place shall not be lower than the Minimum Energy Performance Standard (MEPS) of Dehumidifiers (Table 1) and shall be more than or equal to 95% of the labeled value of products.

Maine Postpones the PFAS Reporting Date for Products Learn more.

USA - Maine Postpones the PFAS Reporting Date for Products

​The Maine's governor signed the bill LD 217 on 8 June amending the existing act - An Act to Stop Perfluoroalkyl and Polyfluoroalkyl Substances Pollution (LD 1503). The law originally required manufacturers of product with intentionally added per- and polyfluoroalkyl substances (PFAS) to report the intentionally added presence of PFAS in those products to the Department of Environmental Protection (DEP) beginning January 1, 2023 and now postpones to ​January 1, 2025.

The original law also prohibits the sale of carpets or rugs, as well as the sale of fabric treatments, that contain intentionally added PFAS beginning on January 1, 2023. Effective January 1, 2030, any product containing intentionally added PFAS may not be sold in Maine unless the use of PFAS in the product is specifically designated as a currently unavoidable use by DEP.

USA - Hawaii Prohibits Mercury-Containing Compact Fluorescent Lamps

​The Governor of Hawaii signed HB 192 into law on 5 July banning mercury-containing compact fluorescent lamps with certain exemptions.

- a screw or bayonet base type compact fluorescent lamp, effective January 1, 2025;

- a pin-base type compact fluorescent lamp or linear fluorescent lamp, effective January 1, 2026.

Exemptions:

​- used for image capture and projection or in preprocessing, lithography, film and video projection and holography;

- high proportion of UV emission lighting;

- used for medical or veterinary diagnosis or treatment or used in medical device;

- used in pharmaceutical product manufacturing or quality control;

- used for spectroscopy and photometric applications;

- used by academic and research institutions exclusively for conducting research and experiments;

- used to replace a lamp in previously manufactured motor vehicles​.

USA - Maine Prohibits Mercury-Containing Compact Fluorescent Lamps

​Maine adopted the Bill HP 1160 on 5 July without the signature of the Governor, banning certain mercury-containing compact fluorescent lamps with exemptions.

​- screw or bayonet base type mercury containing compact fluorescent lamp, effective January 1, 2024;

- pin base type or linear fluorescent lamp containing mercury, effective January 1, 2025.

Exemptions:

​- exclusively for image capture and projection;

- has a high proportion of UV light emission;

- exclusively for use in medical or veterinary diagnosis or treatment or in a medical device;

- exclusively for use in the manufacturing or quality control of pharmaceutical products;

- exclusively for spectroscopy and photometric applications;

- exclusively for use by academic and research institutions for conducting research projects and experiments;

- used to replace a lamp in a motor vehicle that was manufactured on or before January 1, 2020.

EU - Draft Commission Regulation Implementing Directive 2009/125/EC of the European Parliament and of the Council with Regard to Ecodesign Requirements for Household Tumble Dryers, Amending Commission Regulation (EC) No 1275/2008, and Repealing Commission

 

​This draft Commission Regulation covers products designed for the drying of household laundry to be placed on the EU market.

 

The draft regulation lays down minimum energy performance requirements, in particular on power demand in active mode and for the low power modes of household tumble dryers; minimum condensation efficiency performance; appropriate requirements contributing to circular economy objectives in particular, requirements on resource efficiency including availability of necessary spare parts and maximum delivery time thereof, access to repair and maintenance information, information requirements for refrigerant gases, requirements for disassembly for the purpose of repair and for material recovery and recycling, and information requirements. In accordance with the Eco-design Directive 2009/125/EC, household tumble dryers not meeting these requirements will not be allowed to be placed on the EU market. The draft Regulation is based on the findings of technical, environmental and economic studies and takes into account the opinions of the different stakeholders.

Proposed date of adoption: April 2023

Proposed date of entry into force: 20 days from publication in the Official Journal of the EU. The provisions shall apply from July 1, 2025

Final date for comments: 60 days from notification

From January 01, 2023, the legal requirements for the export of products to UK was intended to change. The new UKCA mark should be mandatory and European CE mark finally lose its validity for this market. Now there is a new regulation!

Last Monday, the British government announced that it will continue to recognize the CE mark until the end of 2024. Thereby, extending the deadline for another two years. During this time, both UKCA or CE mark may be used.

Important to consider: Different rules will apply for medical devices, construction products, cableways, transportable pressure equipment, unmanned aircraft systems, rail products, and marine equipment. Which ones is not yet known.

Which consequences occur?

The government also declares to reviewing the wider product safety framework and prove further methods like e-labelling. Until December 31, 2027, the government will allow to affix the UKCA marking and include importer information for products from EEA countries on an accompanying document or label. Until this date, CE conformity assessment activities can also be used as the basis for the UKCA marking, when carried out before December 31, 2024.

​It was announced by METI that Appendix 10 and Appendix 12 of “About Interpretation of Ministerial Ordinance for Establishing Technical Requirements for Electrical Appliances and Materials” were revised on August 31, 2022.

Summary of this announcement:

Appendix 10:
Appendix 10 stipulates the per​missible values of radio noise strength from electrical appliances, but there are no requirements for radiated emission from lighting devices. Since there is a risk that measures against communication interference caused by radio noise from lighting devices are not taken sufficiently, the international technical trends related to radio noise strength have been reflected in this revision.​

Appendix 12:
- 8 J-standards were replaced with a newer edition.
- 16 J-standards were deleted due to the expiration of transition period.

Manufacturers’ obligations consist in drawing up the technical documentation and carry out the conformity assessment procedure set out in Schedule 2 (or have it carried out). ‘Principal elements of the safety objectives‘ are described in Schedule 1, e.g. protection against hazards arising from the electrical equipment or hazards which may be caused by external influences on the electrical equipment. Further obligations apply to authorized representatives, importers and distributors. Different requirements apply in Northern Ireland. TÜV Rheinland is sending this cyber security alert to ensure you are aware of the latest existing threat that could potentially cause severe damage to critical utility and corporate infrastructure.

This week, multiple agencies of the United States Government announced that the control systems of critical infrastructure in the U.S., such as power grids, water utilities and oil refineries, are under threat. The tool for this hack is known as the "Swiss Army Knife" for its expansive utility in being able to penetrate the control systems that are connected to the internet. While it is targeted at industrial systems, the “Swiss Army Knife” is designed to take advantage of technology that exists in large enterprise and corporate systems as well.

While no attribution to the source of the threat has been published, it is considered highly likely that the threat emanates from nation state agencies and cyber criminals that are rushing to take advantage of the war in Ukraine.

TÜV Rheinland would like to ensure that you are aware of the cyber threat and to advise that you take precautions against the threats. Ensure all the system vulnerabilities, such as zero-day vulnerabilities, software patch flaws and even suspicious user access behaviors are evaluated, fixed and monitored. These are some important areas of concern but for a complete security hardening of the systems, it is recommended that you certify to the standards recommended by the various agencies of the US and International Governments. One specific standard to consider is IEC 62443, an international series of standards that address cybersecurity for operational technology in automation and control systems. New BIS Compulsory Registration Scheme

On April 1, 2020, the Indian Ministry of Electronics and Information Technology (Meity) announced that soon 12 additional electronic products will require a CRS approval. These include products in the categories of LED lights, IT and audio/video products as well as household appliances. There will be a transition period of three months, beginning at the release date of the Meity notice.

Together with the Bureau of Indian Standards (BIS), the Meity regulates the testing and certification of these products. Therefore, local and foreign manufacturers, as well as importers and distributors must obtain a mandatory registration from the BIS before they can bring their products on the Indian market.

Product testing by accredited institutions is an essential part of the certification process. To verify that a regulated product conforms to the Indian Standards (IS), TÜV Rheinland India became one of the first laboratories ever to be recognized by the BIS.

With the EU MDR: New Requirements for Hazardous Substances in Medical Devices, it’s more important than ever to understand compliance. Supplier declarations have been proven to be unreliable. Often times, suppliers do not accurately know what their products contain, they lack proper education, and unfortunately, some suppliers have been known to outright lie on their declarations of conformity. However, when it comes down to it, it’s manufacturers who bear the burden of proving their medical device is safe, not the supplier.

  • Have you considered the restrictive list of CLP substances required for “Invasive” materials in your Medical and IVD devices?
  • How will you prove your medical devices contain no substances classified as Carcinogenic, Mutagenic, or Toxic for Reproduction (CMR 1A and 1B)?
  • How will you ensure your medical device upholds the highest possible standard of quality?
  • How can you avoid worst-case scenarios such as a non-conformance, FDA recall, legal litigation and/or possible removal from the market?

EU Medical Device Regulation (MDR) Date of Application Postponed

The Regulation (EU) 2020/561 of the European Parliament and of the Council of April 23, 2020 amending Regulation (EU) 2017/745 on medical devices is published on April 24, 2020 in the Official Journal    of the European Parliament!
 
The main objective to the amendment is to postpone the date of application from May 26, 2020 to May 26, 2021. Along with this postponement, the dates of applications of other provisions were also adopted. Please find the official publication of the Amendment Regulation HERE.

TÜV Rheinland appreciates and supports the postponement as this measure gives medical device manufacturers the opportunity to fully focus all possible resources on the fight against the COVID-19 pandemic. Medical device manufacturers play an important, but challenging role. It is critically important that medical devices remain compliant and continue to be available in the EU in order to avoid shortages or delays of certain medical devices during these unique circumstances.
 
Beyond this situation, TÜV Rheinland would like to encourage its clients to keep in contact with us in order to continue planning activities to implement the Medical Device Regulation, which is also under consideration of the application date of May 26, 2021.

​This draft Regulation relates to a new entry of Annex XVII to Regulation (EC) No.1907/2006. It would restrict the use of diisocyanates as substances on their own, as a constituent in other substances or in mixtures for industrial and professional use(s), individually or in any combination of these diisocyanates, in a concentration above 0.1% by weight. A derogation is provided for the placing on the market and use of these substances and mixtures, if the employer or self-employed worker ensures that adequate training is successfully completed by the industrial and professional users prior to their use.​

Application of the restriction is deferred for 2 years for use and 18 months for placing on the market of diisocyanates to allow sufficient time to adapt and achieve compliance with the regulation.

This draft Regulation relates to an update of Annex II to Regulation (EC) No. 1907/2006 (REACH) on requirements for safety data sheets (SDS):

• Alignment with the Globally Harmonized System of Classification and Labelling of Chemicals (GHS), 6th and 7th revisions, most prominently in Sections 9 (physical and chemical properties) and 14 (transport).

• Alignment with the provisions of Annex VIII (on emergency health response) to Regulation (EC) No. 1272/2008 on classification, labeling and packaging of substances and mixtures (CLP), in particular in relation to the Unique Formula Identifiers (UFIs) assigned to hazardous mixtures, in Section 1 (Identification).

• Alignment with the new provisions for nanoform substances, adopted on December 3, 2018 through the revision of REACH Annexes I, III, and VI-XII to REACH (Commission Regulation (EU) 2018/1881), in Sections 1 (Identification), 3 (composition/information on ingredients) and 9 (physical and chemical properties). In addition to the above three main changes, a number of smaller amendments are proposed to the text, related to recent developments in the Commission's approaches to risk management of chemicals, such as on endocrine disruptors. Application of the amended Annex is deferred to December 31, 2022 to allow stakeholders sufficient time to adapt and achieve compliance.

Description:

The information requirements for the upcoming database on articles containing Candidate List substances (SVHCs) are now published. Companies will need to submit information to the database from January 2021 onwards.

Under the Waste Framework Directive, suppliers of articles containing a substance of very high concern (SVHC) on the Candidate List need to provide information on their safe use to ECHA. The new SCIP database will contain information on substances of concern in articles, as such or in complex objects (products).

A prototype of the database is planned for early 2020. It will be further improved and extended with new features later that year. Companies placing articles on the EU market will need to submit notifications from January 5, 2021. The aim is to promote the substitution of hazardous chemicals and a circular economy.

The information requirements, which define the content of the database, have been developed based on legal requirements and consultations with the European Commission, Member States and stakeholders. Suppliers of articles need to provide:

  • information that allows the article to be identified;
  • the name, concentration range and location of the SVHC in the article; and
  • possibly other information on the safe use of the article.

The SCIP database will provide waste operators with information about the hazardous substances in the waste they process so that material streams can potentially be “cleaned” before recycled and reused in the production of new articles to ensure a true and safe circular economy.

In addition, the increased transparency on the presence of hazardous substances will help consumers to make better informed choices when purchasing products and providing information on how to best use and dispose such articles.

Description:

1. The Republic of Korea has amended the Act on the Promotion of Saving and Recycling of Resources as of December 24, 2018, which will enter into force on December, 25, 2019. The amended Act requires that materials and structures of packaging are graded and evaluated according to their recyclability. Once the grades are determined, they should also be marked on the labels of products, which is to promote the production of easily recyclable packaging. The grades should be labeled on each product, but they have nothing to do with sales ban.
2. The Amendment of sub-Act in August 2019 is for the enforcement procedures defined in the higher Act (Act on the Promotion of Saving and Recycling of Resources).
3. A grace period will be granted after the entry into force of the amended Act in consideration of industry's preparation period. Nine months will be granted for grading and evaluation and up to 15 months for labeling, which adds up to a total of 2 years for the entire grace period.
4. In addition, a ban will be imposed on PVC plastics and colored PET bottles, which have extremely negative impact on the recycling process. However, if such packaging does not have substitutes available on the market or are closely related to people’s diet and medicines, they will be exempt from the ban. Colored PET bottles will be banned only for mineral water and drinks.
5. In principle, a year is given to manufacturers to improve their products’ recyclability. In case there have been changes in the manufacturing process or for similar reasons, a 3-year improvement period is given, and if no improvement is made within this period, either the use of such product is banned or a fine is imposed.

Japan Toy Association announces amendments on toy standard

On 13 June 2018, Japan Toy Association (JTA) revised part 1 of the national toy standard ST 2016 second edition for the physical and mechanical properties after the meeting held in May. The amendments were developed to address the risk against the blockage of infant’s airway. Implementation under ST mark system of the revisions will be applied from 1 January 2019.

China: CCC scope change and implementation methods

On June 11, 2018, China State Administration for Market Regulation and CNCA published an important announcement about big change of CCC approval scope and implementation method. From the date of this announcement, products listed in Annex 1 are no longer in the scope of CCC certification, and the designated certification authority needs to cancel the issued CCC certificates. EU: New proposals for RoHS exemptions

EN 62368-1:2014 Update
62368-1 DOW
The previous update from the Official Journal for the European Union listed the Date of Withdrawal for EN 62368-1 as June 20, 2019. However, Cenelec has published an 18-month extension to change the DOW to December 20, 2020. The 18-month extension date has been delayed in the Official Journal, likely awaiting an Annex ZZ update (relationship between RED and LVD Directives) for EN 62368-1:2014.

Negative Result in the CLC/TC108X Vote
Results of recent voting in the European Union for EN 62368-1:2014/prAB:2018 received a negative result in the CLC/TC108X National Committee of Member Country voting. The deletion of text in clause 4.1.1 was not supported by most member countries. As a result, manufacturers will likely still have the option to use 60950/60065 certified components when using EN 62368-1 2nd edition, even after the Date of Withdrawal. TÃœV Rheinland will continue to monitor the situation and its effect on the upcoming 3rd edition of EN 62368-1.

Voluntary Control Council for Interference: Transition Update
VCCI is Transitioning from VCCI V-3 to VCCI-32
It's Important to understand changes and if new requirements will impact your regulatory compliance requirements. Currently, both version-2 and version-32 can be used. However, after April 2019, all existing and new VCCI registrations must be compliant to VCCI-32.

During the transition period, members can do the following:

  • Submit a report of compliance as New and Add/Modify using V-2 (corresponding to CISPR 22)
  • Manufacture and sell the product and can submit Add/Modify using V-2 (corresponding to CISPR 22)
  • Use VCCI 32-1 (corresponding to CISPR 32) to submit new report of compliance and its Add/Modify

VCCI 32-1 (corresponding to CISPR 32) will be officially implemented in April 2019. For reports submitted using V-2 (corresponding to CISPR 22):

  • Members can continue to sell unless Add/Modify is necessary (neither a change of warning statement or re-submission of a report of compliance using VCCI 32-1 is necessary)
  • When Add/Modify is necessary
  • When a member judges that a change does not affect its EMI characteristics and use of VCCI 32-1 is not necessary, a member can submit a report of compliance using Add/Modifyusing VCCI 32-1
  • When a member judges that a change affects its EMI characteristics and/or correspondence to VCCI 32-1 is necessary, retesting using the technical standard of VCCI-CISPR 32 is necessary. In this case, a member can submit its report of compliance either New or Add/Modify.

When is re-testing required?

  • If the product now has a broadcast radio tuner in it
  • If the product display was not operating as described in CISPR 32
  • If the wireless functions of the product were not active during the original testing

Use VCCI 32-1 (corresponding to CISPR 32) to submit new report of compliance and its Add/Modify.

Please note, warning statements cannot be used for VCCI 32-1 on a product that was already submitted on a report of compliance using V-2.

62368-1 Date Of Withdrawal Update

The latest Official Journal for the European Union lists the Date of Withdrawal for EN 62368-1 as June 20, 2019. The standard UL/CSA 62368-1 has already been adopted in North America, and the dates are currently aligned with the European dates.

Moreover, an IEC 62368-1: Third Edition is currently in development and TÃœV Rheinland will report as this process moves forward. It is expected to be published in mid 2018.

In September of 2015, the European Court of Justice (ECJ) ruled that the original definition of an stands true, meaning Once an Article, Always an Article.

According to:

  • Regulation (EC) No 1907/ 2006 of the European Parliament and of the Council on the Registration, Evaluation, Authorization and Restriction of Chemicals (REACH)
  • Article 7(2) and Article 33 of the REACH Regulation

producers of the articles must both determine and provide communication to users if a substance exceeds 0.1% by weight of an article.
The new guidance document on defining and determining substances in articles under REACH from the European Chemicals Agency (ECHA) is having a major impact on both the supply chain and OEMs of products. Together we’ll discuss the impact, how to define articles and how using a risk-based approach is the best path forward to demonstrate compliance.

Description:

EN 61326-1:2013, EMC standard for measurement, control and laboratory use is changing from the previous version dated 2006. This new version will likely be mandatory in 2015 after which the 2006 version of this standard will be withdrawn and can no longer be used to meet the essential requirements of the EMC Directive. There are technical changes in the new version of the standard that will require re-testing of products.

 

EN 61326-1 defines the immunity environments for different locations: Basic, Industrial, Controlled Electromagnetic (EM) and Portable Test and Measurement (in Annex A).

 

For immunity in ‘Basic’ environments, here are the changes in the 2013 version:

  • 61000-4-2 – The ESD requirement for air discharge has been increased to +/- 8kV, up from +/- 4kV

  • Immunity to magnetic fields according to IEC 61000-4-8 – A power frequency H-field requirement of 3 A/m for both 50 & 60 Hz has been added. This only applies to “magnetically sensitive equipment.”

  •  

For emissions tests, the new version references the CISPR 11:2009 & A1:2010 standard which is recently updated.

 

There are no significant changes in immunity for ‘Industrial’ environments. For ‘Controlled EM’ environments, the “Measurement I/O” port category was eliminated. For ‘Portable Test and Measurement Equipment,’ as in Basic environments, there is a new power frequency H-field requirement of 3 A/m specified in 61000-4-8.

 

In addition to performance criteria for the immunity testing, there is a new section 9 with requirements for EMC information in the user manual.

Description:

N 60335-1 is a standard that deals with the safety of electrical appliances for household and similar purposes.

EN 60335-1 is harmonised according to the LVD (2006/95/EC) and MD (2006/42/EC) directives. Within the scope of the LVD and MD directives, electrical appliances for household and similar purposes (including some products intended for commercial use) shall comply with their applicable particular requirements (EN 60335-2-x) together with EN 60335-1 to receive their CE markings.

TUV Rheinland offers consultancy on minimising your financial risks if your product is assessed against the standard. Products may be placed under a sales ban if they are found not to be in compliance. Furthermore, your company risks the penalties imposed by European authorities if it markets a product that does not comply with the statutory requirements.

The additional requirements of EN 60335-1:2012 may affect the compliance of products previously evaluated according to EN 60335-1:2002+A11+A1+A12+A2+A13+A14+A15.

Marking and instructions:

  • The class III appliance symbol and instruction requirements shall be applied. (7.1, 7.12)

  • Warnings shall prohibit the use of the appliance by children aged less than 8 years and by persons with reduced physical capability. (7.12)

  • Any devices used to start/stop the operational functions of the appliance shall be distinguished from other manual devices. An indication that the device has been operated shall be given via tactile or audible and visual feedback. (7.10)

  • The specific instructions related to the safe operation of the appliance shall be collated together in the front section of the user instructions. The height of the characters, measured according to the capital letters, shall be at least 3 mm. (7.12.Z1)

  • These instructions shall also be available in an alternative format such as a website. (7.12Z1)

Construction requirements:

  • Test probe 18 shall be used to check the appliance’s protection against access to live or moving parts. (8, 20.2)

  • The reinforced insulation is allowed contact with accessible conductive liquids. (22.33)

  • Motors running capacitors in unattended appliances should be at least class P2 or provide equivalent protection to the surroundings. (24.8)

  • Interpolation is allowed when checking creepage distances. Introduced insulation requirements are subject to high frequency voltages. (29)

  • UV appliances: material should be UV resistant, and additional warnings should be available. (Annex ZG)

Testing requirements:

  • General test condition: the updated test condition for the appliance shall have both a self-resetting feature and a non-self-resetting feature. (5.19)

  • Normal heating test: the temperature rise limit of motor-operated appliance enclosures has been revised. It is now 50 K for metal enclosures. (11)

  • Leakage current test: the peak value must be measured for class II, III and 0 appliances. (13)

  • Abnormal evaluation: the evaluation method for software protection circuits has been revised. (19)

  • Abnormal evaluation: main voltage selector switches must be set to the lowest voltage position, and the highest voltage value must be applied. (19.15)

  • Switch endurance test: if the switch operates a relay or contactor, the complete switching system is subject to the switch endurance test. (24.1.3)

  • The fire resistance requirements for small parts must be applied. (30.2.3)

EN 55022:2010 - Start year: : 2010
Description:

EN 55022:2010, emissions standard for ITE products became mandatory on December 1 2013. Effective that date, previous version, EN 55022:2006 and A1:2007 will no longer show compliance with the EMC directive. Manufacturers will need to have the new version on their declarations of conformity. Information technology equipment in scope of EMC directives shall comply with the standard in order to be able to mark your products with CE.

EN 55022:2010 applies to information technology equipment. Procedures are given for the measurement of the levels of spurious signals generated by the ITE and limits are specified for the frequency range 9 kHz to 400 GHz for both class A and class B equipment.

The changes in EN 55022 involve an alternative method for Telco / LAN conducted emissions and an update to the CISPR 16 reference standard. This means that conducted emissions testing must be done with CISPR 16 compliant LISN’s and setup table influence must be included in the uncertainty budget. While these are not significant technical changes, it is a good opportunity for manufacturers to review their declarations of conformity. For example, if A1:2007 is not included on your declaration and you have processor speeds above 108MHz, your product will require radiated emissions testing from 1-6GHz.

N 60335-1 is a standard that deals with the safety of electrical appliances for household and similar purposes.

EN 60335-1 is harmonised according to the LVD (2006/95/EC) and MD (2006/42/EC) directives. Within the scope of the LVD and MD directives, electrical appliances for household and similar purposes (including some products intended for commercial use) shall comply with their applicable particular requirements (EN 60335-2-x) together with EN 60335-1 to receive their CE markings.

TUV Rheinland offers consultancy on minimising your financial risks if your product is assessed against the standard. Products may be placed under a sales ban if they are found not to be in compliance. Furthermore, your company risks the penalties imposed by European authorities if it markets a product that does not comply with the statutory requirements.

The additional requirements of EN 60335-1:2012 may affect the compliance of products previously evaluated according to EN 60335-1:2002+A11+A1+A12+A2+A13+A14+A15.

Marking and instructions:

  • The class III appliance symbol and instruction requirements shall be applied. (7.1, 7.12)

  • Warnings shall prohibit the use of the appliance by children aged less than 8 years and by persons with reduced physical capability. (7.12)

  • Any devices used to start/stop the operational functions of the appliance shall be distinguished from other manual devices. An indication that the device has been operated shall be given via tactile or audible and visual feedback. (7.10)

  • The specific instructions related to the safe operation of the appliance shall be collated together in the front section of the user instructions. The height of the characters, measured according to the capital letters, shall be at least 3 mm. (7.12.Z1)

  • These instructions shall also be available in an alternative format such as a website. (7.12Z1)

Construction requirements:

  • Test probe 18 shall be used to check the appliance’s protection against access to live or moving parts. (8, 20.2)

  • The reinforced insulation is allowed contact with accessible conductive liquids. (22.33)

  • Motors running capacitors in unattended appliances should be at least class P2 or provide equivalent protection to the surroundings. (24.8)

  • Interpolation is allowed when checking creepage distances. Introduced insulation requirements are subject to high frequency voltages. (29)

  • UV appliances: material should be UV resistant, and additional warnings should be available. (Annex ZG)

Testing requirements:

  • General test condition: the updated test condition for the appliance shall have both a self-resetting feature and a non-self-resetting feature. (5.19)

  • Normal heating test: the temperature rise limit of motor-operated appliance enclosures has been revised. It is now 50 K for metal enclosures. (11)

  • Leakage current test: the peak value must be measured for class II, III and 0 appliances. (13)

  • Abnormal evaluation: the evaluation method for software protection circuits has been revised. (19)

  • Abnormal evaluation: main voltage selector switches must be set to the lowest voltage position, and the highest voltage value must be applied. (19.15)

  • Switch endurance test: if the switch operates a relay or contactor, the complete switching system is subject to the switch endurance test. (24.1.3)

  • The fire resistance requirements for small parts must be applied. (30.2.3)
